Terms of Service

Please read these terms carefully. By using BearyEats, you agree to them. Last updated July 11, 2026.

These Terms of Service (“Terms”) are a binding agreement between you and BearyEats (“BearyEats”, “we”, “us”) and govern your access to and use of the BearyEats mobile app for iOS (currently distributed as a TestFlight beta, with a planned Apple App Store release), the website at bearyeats.com, and any related features (together, the “Services”). BearyEats is operated from Romania. By downloading, installing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you are under the age of legal majority where you live, you must have the consent and supervision of a parent or legal guardian. By using the Services, you represent that you meet these requirements.

2. Your account

You sign in with Apple or Google. You are responsible for keeping access to your account secure and for activity that occurs under your account. Notify us at bearyeatssupport@gmail.com promptly if you suspect unauthorized use.

3. Acceptable use

You agree not to:

  • Use the Services to violate any law or regulation.
  • Reverse engineer, decompile, disassemble or attempt to extract the source code of the Services, except to the extent permitted by mandatory local law.
  • Interfere with, disrupt, overload or attempt to gain unauthorized access to the Services, our infrastructure or other users’ accounts.
  • Use scrapers, bots or automated tools to access the Services in a way that exceeds normal personal use.
  • Submit content that is illegal, infringing, defamatory, hateful, sexually explicit, or that contains malware.
  • Resell, sublicense or commercially redistribute the Services or any data we provide, without our written consent.

4. Informational estimates only — not medical advice

BearyEats provides plain-language ingredient explanations, calorie and macro estimates, and an informational score for packaged and everyday food. The Services are intended for general educational and informational use only.

  • BearyEats is not a medical device and is not certified as such.
  • Calorie, macro, and ingredient results are estimates and can be inaccurate or incomplete. They are not exact measurements.
  • The Services do not provide medical advice, diagnosis, treatment, or professional health advice, and are not a substitute for it.
  • BearyEats makes no guarantee of any specific health, weight, nutrition or wellness outcome.
  • Always consult a qualified healthcare professional for medical decisions, especially if you have allergies, food intolerances, a chronic condition, are pregnant or breastfeeding, are caring for a child, or are taking medication.

5. Allergy and ingredient verification — your responsibility

Product databases, retailer feeds and AI-generated content can be incomplete, out of date or wrong, and manufacturers may change formulations without notice. Always read the ingredient and allergen information printed on the physical packaging before consuming a product, especially if you have an allergy, intolerance or specific dietary need. You are responsible for the food choices you make and for verifying the information you rely on.

6. AI-generated and image-based content

BearyEats uses image recognition and OCR (Google Cloud Vision) and AI analysis (Google AI / Gemini) to recognize food, read labels, and explain ingredient and nutrition information. This content can be inaccurate, incomplete or misleading. Treat all output as informational estimates and verify anything important against the physical packaging or another trusted source.

7. Subscriptions, trial and pricing

Some features require a paid subscription. The following applies.

  • Free trial. A free trial may be offered. Any trial length is disclosed in the app before you subscribe. If you do not cancel before a trial ends, your subscription begins automatically and the first payment is charged.
  • Prices. We do not set fixed prices in these Terms. The current price of each plan (for example monthly or yearly) is shown on the paywall in the app, in your local currency where supported, before you confirm. The price displayed before you confirm is the price that applies to you, and may be adjusted by the store for local taxes and conversion.
  • Where you buy. Subscriptions are sold and processed by the app store you install from — currently the Apple App Store, under your Apple ID and Apple’s terms (and by Google Playunder Google’s terms where the app is offered on Android). BearyEats does not collect or store your payment card or bank details.
  • Entitlements. We use RevenueCat to manage subscription entitlements so we can unlock paid features and let you restore purchases across devices.
  • Auto-renewal. Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends, and are charged to your store account at the then-current price for that plan. If a price changes, the store will ask you to confirm before charging you.
  • Cancel anytime.Cancelling stops the next renewal. You keep access to paid features until the end of the current period (or until a trial ends if you cancel during the trial). Manage or cancel in your store’s subscription settings (for example, iOS Settings → your name → Subscriptions → BearyEats).
  • Refundsare handled by the store you bought from, under that store’s policy. Where required by law (for example the EU/UK statutory withdrawal right), additional consumer rights apply and are not affected by these Terms.
  • Restoring purchases. If you reinstall or change device, use Restore purchases while signed in to the same store account used for the original purchase.

8. Battles and community conduct

Battles are optional challenges where you can compete with others using a username you choose. When you participate, you agree to:

  • Choose a username that is not offensive, impersonating, or infringing, and that does not expose personal information you don’t want others to see.
  • Not harass, threaten, abuse, or spam other participants, and not attempt to cheat, manipulate scores, or disrupt Battles.

You can block a participant to hide them from you, and report behavior that breaks these rules. We review reports and may remove content, restrict Battles access, suspend, or terminate accounts that violate these Terms. Moderation decisions are made at our reasonable discretion to keep the community safe.

9. Intellectual property

The Services, including the BearyEats app, the website, our software, designs, logos and content, are owned by BearyEats or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services on devices you own or control, for your personal, non-commercial use, in line with these Terms and the rules of the store you downloaded the app from.

10. User content and feedback

If you submit content to the Services (for example support messages, bug reports, feature requests, product corrections, or a Battles username), you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, adapt and display that content to operate, improve and promote the Services. You represent that you have the rights to share whatever you submit. We may use general feedback or suggestions without obligation or compensation.

11. Third-party services

The Services rely on third parties, including Apple, Google, Supabase (backend, database, authentication and storage), Google Cloud Vision (image recognition and OCR), Google AI / Gemini (ingredient analysis), and RevenueCat (subscription entitlements), and may link to or display content from third parties. Their terms and privacy policies govern your use of their services. We are not responsible for third-party content or services.

12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, THAT INGREDIENT OR NUTRITION DATA OR ESTIMATES WILL BE COMPLETE OR ACCURATE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEARYEATS AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA OR HEALTH OUTCOMES, ARISING FROM OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) USD $50.

Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for fraud, gross negligence, death or personal injury caused by our negligence, or your statutory consumer rights.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold BearyEats harmless from claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

15. Termination

You can stop using the Services at any time by uninstalling the app. You can delete your account from inside the app or by emailing bearyeatssupport@gmail.com (see the Delete Account page). We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if we need to do so to protect the Services, our users or third parties. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, limitation of liability and dispute resolution) will survive.

16. Apple-specific terms (iOS app)

The following applies if you obtained the BearyEats app from Apple (including TestFlight or the App Store). You acknowledge that these Terms are between you and BearyEats only, and not with Apple Inc. (“Apple”). Apple is not responsible for the BearyEats app or its content. Your use of the app must comply with the Apple Media Services Terms.

  • Apple has no obligation to provide any maintenance or support for the BearyEats app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app.
  • BearyEats (not Apple) is responsible for addressing any claims by you or any third party relating to the app, including product liability, consumer-protection or intellectual-property claims.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to your license of the app.

17. Google Play-specific terms (Android app)

If the app is offered on Google Play and you obtain it there, you acknowledge that these Terms are between you and BearyEats only, and not with Google. Your use of the app must also comply with the Google Play Terms of Service. Google is not responsible for the app or its content and, to the maximum extent permitted by law, has no warranty or support obligation for it.

18. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice in the app, by email, or on the website before they take effect. Continued use of the Services after changes take effect means you accept the updated Terms. If you do not accept them, stop using the Services and delete your account.

19. Governing law and disputes

BearyEats is operated from Romania. These Terms are governed by the laws of Romania, without regard to its conflict-of-law principles. Disputes arising from or relating to these Terms or the Services will be resolved by the competent courts of Romania, except where mandatory local consumer law gives you the right to bring a claim where you live or have it heard there. Nothing in these Terms affects your statutory consumer rights that cannot be waived by contract, including, where applicable, the right to use online dispute-resolution platforms made available by the European Commission.

20. Severability and entire agreement

If any part of these Terms is held to be unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and any in-app or store-level terms that apply to a specific feature or purchase, are the entire agreement between you and BearyEats regarding the Services.
